SARA & KyERC
The Kentucky Emergency Response Commission (KyERC) was formed in 1988 in compliance with the federal law passed in the wake of the Bhopal, India chemical tragedy in which 2,500 people lost their lives and tens of thousands more were injured.
Public Law 99-499 established the Superfund Amendments and Reauthorization Act (SARA) Title III – Emergency Planning and Community Right-to-Know Act of 1986 which contains four (4) major provisions:
- Planning for chemical emergencies
- Emergency notification of chemical accidents and releases
- Reporting of hazardous chemical inventories
- Toxic chemical release reporting
PL 99-499 sets forth the specific requirements of the program. KRS 39E implements this federal law and establishes policies and procedures to enable Local Emergency Planning Committees (LEPC’s) to assist their communities in developing standards for planning for the release of hazardous substances in facilities across the state.

Tier II Reporting Guidelines |

Section 312 of SARA Title III requires the annual filing of a chemical inventory reporting form known as “Tier One” or “Tier Two”. The Kentucky Emergency Response Commission REQUIRES the Tier Two form for all of Kentucky facilities required to report.
March 1 is the due date for filing Tier Two, and it covers the previous calendar year. Submission is REQUIRED on form SARA 312. Tier Two and the applicable fee are REQUIRED to be filed SIMULTANEOUSLY to the Kentucky Emergency Response Commission.

FACILITY PLAN REQUIREMENTS
Section 302(c), KRS 39E.130
Facilities subject to the planning requirements must notify the Kentucky Emergency Response Commission, the Local Emergency Planning Committee (LEPC) and the Fire Department with jurisdiction that they are subject to the planning provisions. Facilities must notify the LEPC of the facility emergency coordinator who will work with the local committee and who shall provide information necessary to the development of those plans.
Annual review is required by March 1. If you have an approved plan, please review that plan. Do not develop another plan.
